These Terms and Conditions of Service (hereinafter "Terms") govern access to and use of the website growthos.biz, the GrowthOS technology platform (hereinafter "Platform"), and the services provided by GrowthOS, Lda. (Tax ID 519 178 220), with registered office at Rua Dom Jerónimo Osório, No. 23, 2nd Floor Right, 1400-120 Lisbon, Portugal.
By accessing the website, using the Platform, or contracting GrowthOS services, the user fully accepts these Terms. If you do not agree, you should not use the services.
GrowthOS operates as a Sales Engine Partner, providing integrated B2B commercial growth services through three product layers:
Commercial diagnostics, go-to-market design, ICPs, personas, value propositions, sales playbooks, and revenue planning. Typical duration: 8 weeks.
Configuration and customization of the GrowthOS Platform, including CRM, contact cadences, scoring, dashboards, integrations with external tools, and team training.
Continuous sales engine execution, including SDR/BDR as a Service, SalesOps, prospecting, nurturing, reporting, and continuous optimization. Contracting the RUN module requires prior completion of THINK.
Scoped engineering services for custom commercial software, including but not limited to lead routing engines, AI reporting layers, product configurators, customer portals, and stack integrations. Each Custom Build is defined by a written scope agreed before work begins, with fixed price, fixed timeline, and fixed deliverables. Typical scope: 2 to 8 weeks per build. Custom Builds are delivered to the Client for ownership and operation after handover.
A library of standalone productized tools accessible through the website on a self-serve basis, including Email & Script Generator, Meeting Prep, Battle Cards, Proposal Generator, and Campaign Planner. Tools are accessed individually or through a monthly cap subscription. Outputs are generated on demand and made available to the User for immediate download or copy. Tools work independently from each other and do not require contracting the Sales Engine modules.
Pricing for Sales Engine modules (THINK, BUILD, RUN) and Build Studio Custom Builds is scoped per engagement and defined in the written commercial proposal accepted by the Client. The signed proposal is the binding reference for amounts, billing schedule, and variable components, if any.
Pricing for Growth Tools is published on the Tools section of the website and may be updated from time to time. The pricing displayed at the moment of contracting (whether pay-per-use or monthly subscription) prevails for that transaction.
Sales Engine and Build Studio services are invoiced according to the milestones set in the signed proposal. RUN is invoiced monthly. Growth Tools pay-per-use is billed at output generation; monthly cap is billed at the start of each monthly cycle. Payments for invoiced services are due within 15 days of invoice issuance, unless otherwise agreed. Non-payment may result in service suspension following 10 business days' prior notice.
THINK has a duration defined in the proposal (typically 8 weeks). RUN is contracted with a minimum period of 3 months, automatically renewable for equal periods. Termination must be communicated in writing with 30 days' notice. Early termination does not entitle the Client to a refund of amounts already invoiced for services rendered.
Custom Builds are governed by the scope agreed in the proposal. Termination of a Build before completion requires payment of work delivered up to the termination date.
Growth Tools monthly cap subscriptions may be cancelled at any time and will not renew at the next billing cycle. Pay-per-use does not require cancellation — the User simply stops generating outputs. No annual contracts apply to Growth Tools.
Access to the Platform requires registration and authentication. The user is responsible for the confidentiality of their credentials and for all actions taken through their account.

The Client is responsible for the quality, legality, and lawfulness of data entered into the Platform, including contact and lead lists. GrowthOS is not liable for the use of data obtained in violation of data protection legislation.
Outputs generated by Growth Tools are produced based on inputs provided by the User and may incorporate AI-generated content. The User agrees to:
GrowthOS reserves the right to suspend Tools access for accounts exhibiting abusive usage patterns, after reasonable notice.
The Platform, Growth Tools, and GrowthOS services use artificial intelligence models for commercial content generation, data analysis, and process optimization. The Client and User acknowledge and accept that:
The Platform, including its source code, design, methodologies (THINK, BUILD, RUN), frameworks, templates, and content produced by GrowthOS, are the property of GrowthOS and are protected by intellectual property rights. Reproduction, distribution, or use without authorization is prohibited.
Data, content, and information provided by the Client remain the Client's property. GrowthOS acquires only the usage rights necessary for service delivery.
Documents and materials produced under THINK (GTM Blueprint, Sales Execution Manual, RevOps Roadmap) are delivered to the Client for internal use. The underlying methodology remains the property of GrowthOS. Custom Builds delivered through Build Studio are transferred to the Client for ownership and operation upon final handover and payment of all amounts due, while the underlying engineering patterns and reusable components remain the property of GrowthOS.
Outputs generated by Growth Tools — including emails, briefs, battle cards, proposals, campaign plans, and any other generated content — are the property of the User who generated them, for use without restriction in their commercial activity. The User retains all outputs even after cancelling a monthly cap subscription or discontinuing pay-per-use. The underlying tool, prompts, templates, and engineering remain the property of GrowthOS.
GrowthOS uses its best efforts to ensure continuous Platform availability but does not guarantee:
Scheduled maintenance will be communicated with reasonable advance notice. GrowthOS shall not be liable for unavailability caused by third parties (cloud infrastructure, external APIs, telecommunications providers).
To the maximum extent permitted by law:
Both parties undertake to keep confidential all non-public information obtained in the course of the contractual relationship, including commercial data, strategies, contact lists, performance metrics, and technical information. This obligation survives for 2 years after contract termination.
Personal data processing is governed by GrowthOS's Privacy Policy. When GrowthOS processes personal data on behalf of the Client, the parties enter into a Data Processing Agreement (DPA) defining their respective obligations under the GDPR.
GrowthOS reserves the right to immediately suspend or terminate user access in the event of:
GrowthOS may update these Terms at any time. Material changes will be communicated with 30 days' notice. Continued use of the services after notification constitutes acceptance of the new Terms.
These Terms are governed by Portuguese law. In the event of a dispute, the parties shall seek to resolve the matter amicably. Failing agreement, the courts of Lisbon shall have exclusive jurisdiction, with the parties waiving any other forum.
If any provision of these Terms is found to be invalid, the remaining provisions shall continue in full force and effect. Tolerance of non-compliance by either party does not constitute a waiver of the right to demand future compliance.
